Parental/Guardian Consent & Waiver Form for Adults and Minors (Under 18)

Parent/Guardian Consent and Assumption of Risks (for minors)
I, the undersigned, as the parent or legal guardian of the above‑named child (“Participant”), hereby give my full consent for my child to participate in all activities organized by Beginners 2 Pro, LLC, including but not limited to clinics, private and group lessons, practices, games, travel teams, and any special events (collectively, the “Activities”).

Risks
I understand that baseball activities carry inherent risks, including the potential for serious injury or death. These risks may result from, among other things, weather conditions, traffic, playing conditions, equipment, or actions such as hitting, pitching, fielding, running, jumping, sliding, diving, and collisions with players, volunteers, spectators, or stationary objects.

Health & Fitness
I certify that my child is in good health, physically fit, and has no known physical or mental conditions that could hinder full participation in the Activities unless I have disclosed such information in writing to Beginners 2 Pro, LLC and its coaches.

Liability Waiver
To the fullest extent permitted by New York law, I agree to release, waive, and discharge Beginners 2 Pro, LLC, its owner (including but not limited to Erick Hernandez), officers, employees, coaches, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities of any kind, known or unknown, arising out of or related to my child’s participation in the Activities, including claims arising from the alleged negligence of any Released Party.

Indemnity
To the fullest extent permitted by New York law, I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) my child’s participation in the Activities, or (b) any breach by me or my child of this Agreement.

Participant Assumption of Risks (for adults)
I, the participant, voluntarily accept all risks associated with participating in Beginners 2 Pro, LLC Activities, including all inherent hazards of baseball. I understand these risks may include injury, disability, or death, and I assume full responsibility for my participation, to the fullest extent permitted by New York law.

Photo & Media Consent
I grant permission for Beginners 2 Pro, LLC and its owner, employees, coaches, agents, and representatives to take photographs or digital recordings of me or my child during Activities. I agree that these images may be used for training, promotional, or marketing purposes in any media format without compensation or further approval, and I waive any rights to inspect or approve such media, to the fullest extent permitted by New York law. If I do not wish to grant this permission, I will notify Beginners 2 Pro, LLC in writing before participation begins.

Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict‑of‑law rules. Any dispute arising out of or relating to this Agreement, the Activities, or the Training Materials (as defined below) shall be brought exclusively in the state courts located in the County of [Queens / Kings / New York / Bronx / Richmond], New York, and Participants and Parents/Guardians consent to the personal jurisdiction and venue of such courts.

Intellectual Property, No Recording, and Confidentiality

Intellectual Property & Limited License
All curriculum, drills, training methods, techniques, verbal instruction, written materials, graphics, handouts, video demonstrations, video breakdowns, and any other content or materials provided or created by Beginners 2 Pro, LLC or its owner, coaches, or representatives (including but not limited to Erick Hernandez) (collectively, the “Training Materials”) are and shall remain the exclusive property of Beginners 2 Pro, LLC.

Participants and Parents/Guardians are granted a limited, personal, non‑exclusive, non‑transferable, revocable license to use the Training Materials solely for the individual Participant’s own personal training and development. This license does not permit any commercial use, group instruction use, resale, or sharing of the Training Materials with other players, parents, teams, trainers, coaches, clubs, or organizations.

No Recording of Sessions
To protect participant privacy and the proprietary nature of the Training Materials, Participants and Parents/Guardians are strictly prohibited from:

Audio‑ or video‑recording any part of any in‑person or online session, lesson, clinic, practice, game, or event conducted by Beginners 2 Pro, LLC, including but not limited to live coaching, explanations, demonstrations, or feedback; and
Taking photographs, screenshots, or screen recordings of live or recorded sessions, online meetings, or any digital content provided by Beginners 2 Pro, LLC,

unless they have obtained prior written permission from Beginners 2 Pro, LLC.

If a Participant desires video‑based feedback, the Participant may submit video footage that they have independently recorded outside of Beginners 2 Pro, LLC sessions, subject to any technical or privacy guidelines provided by Beginners 2 Pro, LLC. Any analysis, feedback, voice‑over, or written notes provided by Beginners 2 Pro, LLC in connection with such video will be considered Training Materials and will be governed by this section.

Confidentiality & Non‑Disclosure
Participants and Parents/Guardians acknowledge that the Training Materials, including unique drills, progressions, cues, explanations, teaching systems, and training programs developed over years by Beginners 2 Pro, LLC and its owner (including but not limited to Erick Hernandez), are confidential and proprietary.

Participants and Parents/Guardians agree that they shall not, without the prior written consent of Beginners 2 Pro, LLC:

Share, disclose, teach, or otherwise communicate the Training Materials or unique coaching methods to any third party (including, but not limited to, other players, parents, trainers, coaches, instructors, teams, clubs, facilities, or organizations), whether verbally, in writing, or in any digital form;
Post, upload, publish, or distribute the Training Materials, or any recordings, photographs, or screenshots of sessions, on social media, websites, messaging apps, forums, or any online or digital platform; or
Use the Training Materials to create, market, or provide any baseball or sports training program, facility, camp, clinic, or similar service that relies on or is substantially based on the Training Materials.

Limited Competitive Use Restriction (Use of Training Materials Only)
Nothing in this Agreement is intended to prevent any person from playing baseball, joining or forming teams, or operating a baseball‑related business using their own independently developed methods and knowledge. However, Participants and Parents/Guardians agree that they shall not, for a period of [12–24] months after the Participant’s last activity with Beginners 2 Pro, LLC, within a [10–15] mile radius of any facility regularly used by Beginners 2 Pro, LLC:

Use the Training Materials, or any substantial part of the Training Materials, to create, operate, or assist in the creation or operation of any baseball or sports training program, camp, clinic, or instructional service that competes with Beginners 2 Pro, LLC.

This restriction is intended to protect proprietary Training Materials and confidential methods, and not to restrict lawful competition based on independently developed skills or knowledge.

Remedies for Breach
Participants and Parents/Guardians understand and agree that any violation of this section may result in:

– Immediate termination of the Participant’s access to all programs and services of Beginners 2 Pro, LLC, without refund; and
– Beginners 2 Pro, LLC seeking all remedies available at law or in equity, including but not limited to monetary damages and, where appropriate, court orders (injunctive relief) to stop further use or disclosure of the Training Materials.

Acknowledgment & Agreement
I confirm that I have read this entire document, understand its terms, and agree to abide by all rules and waivers outlined. I acknowledge that this document is a legal release of liability and a binding contract, to the fullest extent permitted by New York law.
